CA SB 553 Overview

In California, State Senator Dave Cortese played a key role in drafting and advancing Senate Bill 553 (SB 553), a landmark law aimed at preventing workplace violence. The bill requires employers—including those operating in schools, public venues, and places of worship—to implement comprehensive violence prevention plans as part of their safety protocols. To bring the bill into effect, Governor Newsom approved, signed and enacted this mandated Bill effective July 1, 2024 for all to comply. He assigned Cal/OSHA to monitor compliance and gave them the authority to cite those who fail to create training for their employees, proactive measures, preventative solutions and preparedness for these unforeseen incidents.
Key Requirements
- Written WVPP: Employers must create and maintain a written plan, either standalone or integrated into their Injury and Illness Prevention Program (IIPP).
- Employee Involvement: Employees must participate in developing and reviewing the plan.
- Training: Annual training for all employees on workplace violence prevention, reporting procedures, and emergency response.
- Incident Log: Maintain a Violent Incident Log and records of hazard assessments and corrective actions.
- Emergency Protocols: Include response procedures for incidents such as active shooter situations.
Who Must Comply?
- Nearly all California employers, except:
- Healthcare facilities already regulated
- Law enforcement agencies
- Correctional facilities
- Teleworkers in locations not controlled by the employer
- Workplaces with fewer than 10 employees and not open to the public
Enforcement
- Cal/OSHA enforces compliance.
- Penalties range from $18,000 to $25,000 per violation for non-compliance
